It’s as old as time. Good versus Evil, God versus all selfishness in man, North versus South, Batman versus Joker, and East Texas versus … innovation? It shouldn’t be limited to East Texas only; rather, it should be patent infringement abuse versus innovation.

But for the today, we should look at what East Texas’ possible part is in slowing do innovation. Although patent infringement cases themselves has only grown nationally a slight margin, the number of cases happening in the towns of Marshall, Texarkana, and Tyler has multiplied beyond belief.

And it is believed by some that there is an abuse of the legal system as companies are looking to profit off of patent infringement lawsuits, and this can stunt innovation and invention. This is especially true for what is being done by these so called “patent trolls”.

A “patent troll” is a company that looks to make its profit through gains earned through lawsuits versus other companies that has a product or technology that has infringed on their patent. The big catch, and what has attributed to slowing down innovation, is that many times these “patent trolls” look to buy patents off of others without any plan to manufacture the invention.

That in of itself is anti- productive, but what has further hindered the productivity is how these “trolls” as well as others have won an incredible amount of patent litigation cases. What does that have to do with innovation?

Well, either these companies have less money to invest in new technology or are hesitant to invest for fear of being targeted or even further, they don’t have the patent of an idea because one of these “patent trolls” holds it. And, unfortunately, East Texas has played it’s part based on a high rate of awarding cases to “patent trolls” and others.

Recently in the United States, there has been a huge surge in intellectual property rights cases as patent trolling becomes more and more popular. Some areas such as East Texas are well known for being a haven for these cases due to the fact that those judges and juries have a long history of awarding large monetary compensations to patent trolls when copyright infringement cases are brought against large companies. Still, no matter what part of the country you are in, there are many more copyright infringement cases brought forth by patent trolls looking to make a quick lump sum than those that are filed by inventors looking to protect their idea or product.

The way that our legal system is set up allows for complete abuse by patent trolls, and it has proven quite lucrative. For one, United States patent law is arranged so that the patent holder doesn’t even have to produce the product in question to be able to sue for copyright infringement. Because of this, patent trolls can buy patents for cheap and simply use them to barter with big companies with no intention at all of ever using the patents to produce a product or other tangible object.

While there are many happy patent trolls out there, there are also plenty of people against the abuse of the legal system. There has been plenty of talk of the need for patent reform, but nothing has changed so far. For now, the playing field is wide open to patent trolls.

When people talk about “property rights”, a common quote is “Possession is nine tenths of the law”. For example, little Johnny is playing in the dirt with a red dump truck. Charlie wants to play with the dump truck, so he tells the teacher that the dump truck belongs to him and he wants it back. Over the last few years, East Texas has become one of the most popular spots in the country for patent trolls and others seeking an almost sure win for a patent or copyright infringement case. The district court in East Texas is pretty well known for siding with plaintiffs in patent cases.
