Politics and patent infringement cases in East Texas, what is the connection?

September 21st, 2011

patent litigation law firms and politicsYes, politics do play a part. Well, at least when it comes to patent infringement cases, it seems that it has. An interesting report has gone out where it ranks court districts under certain categories in patent litigation.

The eastern court district of Texas has a strong reputation for being the forum of choice for patent infringement cases, yet surprisingly enough it does not rank first in any of the important categories.

The western district of Wisconsin ranks first when it comes how much time it takes to process a litigation cases with a little over six months, yet they are often overlooked as a forum for the infringement cases.

This has given them quite the chip-on-the-shoulder. So the question begs to be asked, what makes the eastern Texas district more appealing? There is a separation between these two states that is more than six Midwest states and that separation is political worldview.

It is safe to say that the majority of Texas leans conservative and the majority of Wisconsin leans liberal. Taking what we know about the two views, we know that conservative Texans are big on property rights, whether it’s physical or intellectual property.

Now, it’s not to say that the people of Wisconsin don’t feel the same, but when it comes to the whole issue of “what is mine, is mine” there ain’t no place like Texas.

And when it comes to plaintiffs picking there “forum” of choice, the one category that overrules them all is the amount of victories in a district. And where East Texas ranks 7th with a 40 percent win rate, Western Wisconsin ranks 28th with a 24 percent win rate.

There are many factors that can play into why there is such a gap in percentage, but you can bet that part of it is the difference in political views.

Tire Barn and The Big Tire Depot

July 30th, 2010

A year and a half ago I wrote a short article on the Tire Barn in Tyler TX. Given the week I’ve just had however, I thought that a new testimonial would be in order. While I knew that my alignment was in need of servicing, it was not severe enough to get me to spend the forty dollars to have it checked and adjusted.

That is until it suddenly became dramatically worse. While driving home in the pouring rain, I found myself fighting to maintain a straight ahead course. The problem was slightly better on a dry road but it proved to be more than simply a traction issue. A day later I took the car in to the tire barn.

Unfortunately but predictably, it was more than simply an alignment issue a well. Turns out, the starboard control arm had gone bad and had to be replaced.

I wasn’t surprised to find a bigger issue but neither was I excited about the prospect of dropping the cash for the repair, unfortunately waiting until a more financially opportune time to make the repair simply wasn’t an option. The folks at the Tire Barn were a great help.

While I went to lunch, they called around, got the parts and made the repair! The only thing they were unable to do was find a used tire to fit my needs. Rather than buy one new tire, I paid a visit to another Tyler business with whom I’ve become a little too familiar lately.

For the most part, the Tire Barn has been very successful in servicing my little vehicle. For more information visit their webpage at www.tbtyler.net. To contact their office call (800) 738-5791. They are located at 13687 FM 206 in Tyler.

Tires Big Depot, (TBD) although awkwardly named, has never failed to find tires for my car, even when the Tire Barn was out of stock. I’m told they are a difficult size to find, but the hard working guys at TBD have yet to experience this difficulty.

And after needing tires a couple of times the last six months or so, I’ve given them ample opportunity to run out of product. They have yet to let me down. They are located on the corner of Houston and S Gentry at 532.

To reach them by phone (which is generally not necessary) call 903-595-3161. Both of these establishments have proven to be great Tyler businesses. If one can’t help, I’ll wager the other can.

Firestation Auto Center

January 1st, 2010

Firestation Auto Center is quickly becoming one of the best used car dealers in Tyler Texas. Located off the corner of Vine and Glenwood, it is a drive from the other quality used car dealers found mostly on the loop. Located on the spot of the old Tyler fire house, Firestation has a distinct Tyler feel to it, allowing a pleasant experience. I went by during my search for a car not long ago and left feeling that although they didn’t have the car I was looking for, they treated me unlike any other dealer I visited and when my car finally bites the dust Firestation will be the first place I visit.

One thing that always bothers me with the search for a new car is the ferocity with which the salesmen approach me. There’s nothing like the feeling you get when you drive into a parking lot and are pressured to make a huge purchase on a moments notice. Like a zebra being preyed on by drueling hyenas. At Firestation this can not be further from the case. At Firestation I wasn’t approached until I looked around for someone to ask about the car.

The salesmen were experts on every car on the lot and were never too pushy. Allowing me to enjoy looking at the cars without being asked if I’m going to buy it before I even see the inside.
Firestation only selects 40 to 50 cars due to the size of the lot so there is a chance you won’t find what you are looking for. The prices are as decent as the other used car lots in Tyler and unlike most of the other dealers, Firestation offers some sort of warranty on the majority of their vehicles. Although most of the warranties last around six months, it is a step up from the “as-is” status at most used car dealers.

Firestation is under new ownership, but little has changed in how the dealership has operated. The service is still top of the line and since they have stayed with the idea of only selecting a few vehicles, the quality of the vehicles is great for used vehicles, having few to no vehicles with high mileage on them.

Twenty five years of service says that Firestation is one of the highest caliber dealers in the east texas area. Every time I drive by the dealer I can’t help slowing down and checking out their newest cars on the lot and since some of the cars have posted prices it keeps the bartering mainly out, allowing everyone the same purchasing opportunities.

The down side to this dealer is that the financing of their vehicles is somewhat limited. If you have financing lined up I’d recommend checking out Firestation auto center the next time you are in the market for a new car. Since Firestation does have a website allowing you to view a large selection of the cars in their inventory, you can car shop without leaving the house if you so choose to.
